Additional Terms for Mayday Services

Account Registration. To access certain features of the Service, you must create an account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain the security of your account credentials and not share them with any third party; (c) promptly update your account information if it changes; and (d) accept responsibility for all activities that occur under your account. You must notify us immediately at hello@mayday.sh if you become aware of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

Subscription and Payment. Mayday offers subscription plans with different pricing tiers. By subscribing to a paid plan, you agree that: (a) subscription fees are billed on a recurring monthly or annual basis through our payment provider and are non-refundable except as described in our Refund Policy; (b) postage fees are charged on a per-postcard basis at the rate associated with your current plan; (c) you authorize us to charge your chosen payment method for all applicable fees; (d) if a payment fails, we may suspend your access to paid features until the outstanding balance is resolved; (e) we may change our pricing upon 30 days' written notice, and your continued use of the Service after the price change takes effect constitutes acceptance of the new pricing; and (f) you may upgrade, downgrade, or cancel your subscription at any time, with changes taking effect at the end of your current billing period. No partial refunds are issued for unused time remaining on an annual subscription.

Service Modifications and Availability. We reserve the right to modify, update, or discontinue any part of the Service at any time, with or without notice, including changes to features, integrations, and third-party service providers. We do not guarantee uninterrupted or error-free availability and shall not be liable for downtime or service interruptions caused by maintenance, updates, or factors beyond our reasonable control.

Communications. By creating an account, you consent to receive service-related communications via email, including account notifications, campaign status updates, sync alerts, billing confirmations, and performance reports. These are necessary for the operation of the Service. You may manage your notification preferences in your account settings. Marketing communications such as newsletters require separate opt-in and you may unsubscribe at any time.

Physical Mail Fulfillment and Recipient Data. Our Service enables you to create and send physical postcards to recipients whose information you provide or import from connected third-party platforms (e.g., Shopify, BigCommerce). By using the Service, you acknowledge that: (a) you are the data controller for all recipient personal data (including names and postal addresses) that you provide or sync to the Service; (b) you have obtained all necessary consents and legal bases to share such recipient data with us for the purpose of printing and mailing postcards on your behalf; (c) we act as a data processor with respect to recipient data and will process it solely to fulfill postcard delivery through our third-party print and mail partner; (d) we are not responsible for the accuracy, legality, or appropriateness of the content you create or the recipients you select; and (e) once a postcard has been submitted for printing and delivery, it cannot be recalled or modified.

Postcard Content and Compliance. You are solely responsible for the content of any postcards created and sent through the Service. You represent and warrant that your postcard content does not violate any applicable laws in the jurisdictions where postcards are sent or received, does not contain material that is defamatory, obscene, threatening, or otherwise objectionable, and does not infringe the intellectual property rights of any third party. We reserve the right to refuse to print or deliver postcards that we reasonably believe violate these Terms, applicable law, or our Acceptable Use Policy.

Right to Terminate

We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Croatia. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
